Section 5(a)(1) of the Occupational Safety and Health Act of 1970:The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) At dock 35 and 53 , employees were only able to lift the damaged manual dock plates partially with a dock lever (metal bar) and would then use their hands to flip the dock plates the rest of the way. Employees were exposed to struck-by hazards when using their hands to flip the lip of the dock plate to rest onto the trailers. Among other methods, one feasible and acceptable method to correct this hazard is to follow the American Society of Mechanical Engineers/ American National Standards Institute (ASME/ANSI) MH 30.1 2007 For the Safety, Performance and Testing of Dock Leveling Devices, Section 5.4.4 by conducting the manufacturers recommend periodic inspection and performing the manufacturers recommend maintenance to maintain the manual dock plates in good working condition.
