29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    a) At the establishment, an employee who operated the Hyster 135 industrial truck had not received the training required by 1910.178(l) exposing employees to struck-by hazards.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.    a) At the establishment, operators of the Hyster industrial truck were aware that the truck's brakes were inoperable and the industrial truck was not taken out of operation exposing employees to struck-by hazards.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    a) At the establishment, the Hyster industrial truck was not inspected prior to being placed in service and was not inspected after each shift. The Hyster industrial trucks brakes were inoperative exposing employees to struck-by hazards.

29 CFR 1910.179(j)(2): Frequent inspection. The following items shall be inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections. All deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard:    29 CFR 1910.179(j)(2)(iii): Hooks with deformation or cracks. Visual inspection daily; monthly inspection with a certification record which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the hook inspected. For hooks with cracks or having more than 15 percent in excess of normal throat opening or more than 10° twist from the plane of the unbent hook refer to paragraph (l)(3)(iii)(a) of this section.    a) At the establishment, the R&M 5-ton overhead crane located on the east end of building #1 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     b) At the establishment, the Yale 5-ton overhead crane located on the west end of building #1 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     c) At the establishment, the Yale 5-ton overhead crane located in building #1 between the east end overhead crane and the west end overhead crane had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     d) At the establishment, the P&H 10-ton overhead crane located in building #2 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     e) At the establishment, the Crane Tech 10-ton overhead crane located in the back of building #3 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     f) At the establishment, the Saturn 7 1/2 ton overhead crane located in the front of building #3 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.     g) At the establishment, the Saturn 7 1/2 ton overhead crane located between the Crane Tech 10 ton overhead crane and the Saturn 7 1/2 ton overhead crane in the front of building #3 had not received daily and monthly hook inspections as required exposing employees to struck-by hazards.
