29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about April 18, 2014, Apex Plumbing Inc. did not ensure that each employee in an excavation was protected from cave-in hazards. The employer did not use an adequate protective system in accordance with OSHA 1926.652(c) standards. The employees were working in a trench in excess of 10 feet exposing employees to the following conditions: 1. The ends of the trenches in the road and in the yard area were unprotected in that no end shores or other means were used to protect these areas. 2. The vertical shores that were in use were placed a distances in excess of shoring requirements for horizontal spacing. Where only one shore was used in the trench located in the road while employees were working in the trench. This trench was measured in excess of 10 feet in length. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 313715278, citation number 2, item number 2 and was affirmed as a final order on January 5, 2010, with respect to a workplace located at 880 Welch Street, Lakewood, Co 80226. Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 311905376, citation number 2, item number 1b and was affirmed as a final order on August 26, 2008, with respect to a workplace located at 1910 W. Arkansas Ave., Denver Co 80223.
