29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    (a) On or about August 6, 2018, Apex Plumbing, Inc., exposed its employees to struck-by injuries while working inside an unprotected excavation approximately 5 feet 6 inches in depth. The employer undercut the curb above the excavation where employees were working without the benefit of a support system being in place to prevent the curb collapse.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a) On or about August 6, 2018, Apex Plumbing, Inc. employees were exposed to cave-in hazards while working in an unprotected trench that had not been evaluated for hazards by a competent person on site. The trench was approximately 5 feet 6 inches deep and required a protective system, ladder for egress purposes and a protective system for the undercut curb.

Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2) , which was contained in OSHA inspection number 970230 , citation number 1, item number 2 and was affirmed as a final order on 07/09/2014 , with respect to a workplace located at 5181 S. Pennsylvania St., Greenwood Village, CO 80121.

The employees were working in a trench with vertical walls in excess of 5 feet deep.         Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a)(1), which was obtained in OSHA inspection number 970230, citation number 1, item number 1 and was affirmed as a final order on 07/09/2014, with respect to a workplace located at 5181 S. Pennsylvania Street, Greenwood Village, CO 80121.    Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a)(1), which was obtained in OSHA inspection number 313715278, citation number 2, item number 2 and was affirmed as a final order on January 5, 2010, with respect to a workplace located at 880 Welch Street, Lakewood, Co 80226.     Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a)(1), which was obtained in OSHA inspection number 311905376, citation number 2, item number 1b and was affirmed as a final order on August 26, 2008, with respect to a workplace located at 1910 W. Arkansas Ave, Denver Co 80223.
