29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) On or about March 03, 2023, employees were exposed to cave-in hazards while working in a trench greater than 5 feet in depth without an adequate protective system in use. The trench the employees were working in measured approximately 2 feet wide and 11.5 feet in depth and employees were working in the part of the trench that was outside the protective system. Apex Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1335969, citation number 2, item number 2, and was affirmed as a final order on April 22, 2019, with respect to a workplace located at 7995 E. Prentice Ave., Greenwood Village CO. 80111.
