29 CFR 1926.20(b)(2): Employer did not provide programs for frequent and regular inspections of the job sites, materials, and equipment to be made by a competent person designated by the employer: a) CM Roofing LLC at 2156 S. University Blvd., Denver, CO 80210: On 4/28/14, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work on the roof without fall protection. This condition exposed employees to a fall hazard of approximately 23 feet. Abatement Note: OSHA defines a competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety nets systems, or personal fall arrest system, nor was an alternative fall protection measure provided: (a) CM Roofing, LLC at 2156 S. University Blvd., Denver, CO 80210: On and before 4/28/14, the exposing employer did not ensure that fall protection systems were utilized by employees engaged in re-roofing activities while working at the unprotected edges of a roof on a residential apartment building. The warning line system and a safety monitor was not used. Condition exposed employee to fall hazards of approximately 23 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
