29 CFR 1926.1437(h)(2): Monthly. In addition to meeting the requirements of 29 CFR 1926.1412 for inspecting the crane/derrick, the employer must inspect the barge, pontoon, vessel or other means of flotation used to support a floating crane/derrick or land crane/derrick on a monthly basis to ensure the items listed in (h)(2)(i) through (h)(2)(v) are in proper, safe and good working conditions at all times. The employer must ensure that the inspection must to be conducted by a competent person: Mr. Barge : The owner/employer did not ensure that a monthly inspection of the barge for the items listed above was completed by a competent person to ensure the employees were protected from the hazards associated with the sub items at all times.

In addition to meeting the requirements of 29 CFR 1926.1412 for inspecting the crane/derrick, the employer must inspect not only the barge, pontoons, vessel or other means of flotation used to support a floating crane/derrick or land crane/derrick, but also the external vessel/flotation devices on a yearly basis to ensure the items listed in (h)(4)(i) through (h)(4)(iii) are in proper, safe and good working conditions at all times: Mr. Barge : The owner/employer did not ensure that a yearly inspection of the barge for the items listed above was completed by a competent person to ensure the employees were protected from the hazards associated with the sub items at all times. owner / employer did not inspect the following items to ensure the employees are protected from capsize.
