29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a)  On or about May 16, 2014, employees were exposed to cave-in hazards while working in a trench that had not been inspected by a competent person before work started. 29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4):    (a)  On or about May 16, 2014, and at times prior, the employer exposed employees to cave-in hazards by directing them to work in a trench with C Type soil that was benched at a slope of 2:3.5 (70 degrees). 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a)  On or about May 16, 2014, employees were not provided means of egress from an excavation that was 5.5 feet deep.      Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").    NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 896649, citation number 1, item number 1 and was affirmed as a final order on May 15, 2013, with respect to a workplace located at 1305 S. Zanta Street in Aurora, Colorado.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)  On or about May 16, 2014, employees were exposed to roll-in and falling object hazards from the spoil pile that was placed at the edge of the excavation where the employees were working.  The soil in the spoil pile was Type C.     Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
