OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to tip-over hazards:    (a) On or about November 29, 2017, and at times prior,  NCB, LLC dba Nordstrom Commercial Builders' employees were operating a JLG Telehandler, Model G6-42A, in a manner for which it was not intended by lifting personnel on a non-approved JLG work platform and driving the Telehandler, Model G6-42A, with the boom raised. Employees were being lifted on a wooden pallet 48 inches by 40 inches.       Reference JLG Operation and Safety Manual, Section 1: General Safety Practices that states "Do not drive with boom raised" and "When lifting personnel, use only a JLG approved personnel work platform, with proper capacity chart displayed in the cab." Section 5.2 listed several reasons for not to use unapproved attachments, such as "The ability of a non-approved attachment to perform its intended function safely cannot be assured."     Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
