29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a)  On or about August 10, 2016 and at times prior, an employee was not provided with safe means of egress from an excavation that was 6.3 feet deep. A 6-feet A-frame ladder was placed inside the trench but was not adequate for the employees to use. The ladder did not have the spreader bars locked in the open position, was tilted to one side, did not extend at least three feet above the landing surface, and was not used for the purpose which it was designed for, such as fully extending the spreader bars and not using the top two steps of the ladder.          NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 977817, citation number 3, item number 1 and was affirmed as a final order on August 11, 2014, with respect to a workplace located at 1936 Liggett Rd., Castle Rock, CO 80109.    NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 896649, citation number 1, item number 1 and was affirmed as a final order on May 15, 2013, with respect to a workplace located at 1305 S. Zanta St., Aurora, CO 80016.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)  On or about May 16, 2014, an employee was exposed to roll-in and falling object hazards from clumps of soil from the spoil pile and a 20 feet metal pipe on the fork of the forklift on an angled position that were placed at the edge of the excavation. The clumps of soil and the metal pipe could roll into the trench where the employee was working.    NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 977817, citation number 4, item number 1 and was affirmed as a final order on August 11, 2014, with respect to a workplace located at 1936 Liggett Rd., Castle Rock, CO 80109. 29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a)  On or about August 10, 2016, an employee was exposed to cave-in hazards while working in a 6.3 feet deep trench. The competent person did not perform any type of manual test to properly determine the soil type and did not conduct adequate inspections to address hazardous conditions prior to allowing employees to work in the trench. Also, a 20 feet metal pipe was located near the edge of trench that was placed on the fork of the forklift. The forklift was parked on an angled position and putting the metal pipe on an uneven position.        NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 977817, citation number 3, item number 1 and was affirmed as a final order on August 11, 2014, with respect to a workplace located at 1936 Liggett Rd., Castle Rock, CO 80109.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a)  On or about August 10, 2016, an employee was exposed to cave-ins while working in an unprotected trench which was approximately 6.3 feet deep. The trench had vertical straight cut walls and was not provided with a cave-in protective system. The soil was classified as B type granular soil.   NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 896649, citation number 1, item number 3 and was affirmed as a final order on May 15, 2013, with respect to a workplace located at 1305 S. Zanta St., Aurora, CO 80016.
