29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION/CONDITION) (DESCRIBE HAZARD)    a) Universal Marble and Granite, LLC. located in Perrysburg, Ohio; On or about June 11, 2014, the employer failed to establish and implement a written respiratory protection program to address identification and evaluation of respiratory hazards, medical evaluations, fit testing, proper use of respirators, maintenance and care of respirators, training and information, program evaluations, and record keeping. Employees were required to wear a negative pressure filtering face piece respirator during cutting operations. Employees were exposed to hazards from silica, including silicosis and lung cancer.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Universal Marble and Granite, LLC. located in Perrysburg, Ohio; On or about June 11, 2014, the employer failed to provide medical evaluations for those employees who were required to wear tight-fitting face piece respirators. Employees were required to wear a negative pressure filtering face piece respirator during cutting operations. Employees were exposed to hazards from silica, including silicosis and lung cancer.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  a) Universal Marble and Granite, LLC. located in Perrysburg, Ohio; On or about June 11, 2014, the employer failed to provide fit testing to those employees who were required to wear negative pressure filtering face piece respirators while cutting marble and granite. Employees were exposed to hazards from silica, including silicosis and lung cancer.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(h)(2)(i): All respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals, and they were not packed or stored to prevent deformation of the facepiece and exhalation valve.  a) Universal Marble and Granite, LLC. located in Perrysburg, Ohio; On or about June 11, 2014, the employer failed to ensure that negative pressure filtering face piece respirators were properly stored to avoid contamination. Employees reused respirators that had been left in the open at their work area exposing them to hazards associated with crystalline silica, such as, but limited to silicosis and lung cancer.
