OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from struck by and crushing injuries while working around powered industrial trucks with boom attachments which were not secured to the lift;    a.)    On or about March 15, 2017, the employer did not ensure employees were protected while moving granite slabs with the Vestil Manufacturing forklift boom lift attachment (Serial #5296511). Employees are required to use the boom lift that is not attached to the carriage, to move granite slabs throughout the facility, exposing employees to crushing hazards in that the boom lift slides off the forks.      b.)    On or about March 15, 2017, the employer did not ensure employees were protected while moving granite slabs with the Wesco forklift boom lift attachment. Employees are required to use the boom lift that is not attached to the carriage, to move granite slabs throughout the facility, exposing employees to crushing hazards in that the boom lift slides off the forks.        Among others, one feasible method of abatement is to ensure an adequate means to secure the attachments to the forklifts are implemented on both the Wesco and Vestil lifting booms before any further use to protect against sliding off the forks as indicated in manufacturer literature. Additionally, training should be conducted for all operators of the forklift boom lift to instruct the proper way to secure the boom lift to the carriage.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:   On or about March 15, 2017, the employer did not ensure that the Yale LP sit down Model LP0801, Serial #B813D02681U forklift was properly marked to include the Wesco boom front-end attachment while showing the approximate weight of the lift truck and attachment combination at maximum elevation with the load laterally centered.  Employees were not aware of the lifting capacity of the lift truck and boom, leaving a potential for tip-over from being overloaded, exposing employees to crushing hazards.
