On or about June 11, 2014 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.  On or about June 11, 2014- at the above addressed jobsite, employees working from the roof top, more than twenty five (25) feet above the ground were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR 1926.501(b)(3): "Hoist areas." Each employee in a hoist area shall be protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. If guardrail systems, [or chain, gate, or guardrail] or portions thereof, are removed to facilitate the hoisting operation (e.g., during landing of materials), and an employee must lean through the access opening or out over the edge of the access opening (to receive or guide equipment and materials, for example), that employee shall be protected from fall hazards by a personal fall arrest system.  a.  On or about June 11, 2014 - at the above addressed jobsite, an employee in a hoist area was exposed to falls of more than twenty five (25) feet, created by the presence of an unprotected roof edge, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.451(g)(1)(ii): Each employee on a single-point or two-point adjustable suspension scaffold shall be protected by both a personal fall arrest system and guardrail system;  a.  On or about June 11, 2013 - at the above addressed jobsite, two employees were conducting masonry operations from a two point suspended scaffold platform more than twenty five (25) feet above the ground.  One employee was not protected by the personal fall arrest system, thereby exposing the employee to a fall.  JC & SON MASONRY, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.451(g)(1)(ii), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 97385, CITATION NUMBER 1, ITEM NUMBER 3 AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 31, 2011 WITH RESPECT TO A WORKPLACE LOCATED AT 1243 EDDY, CHICAGO, IL  60613.
