OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to burns to the eyes from hazardous material such as but not limited to sulfuric acid:    a) Melt-Pour Area: When conducting such task as but not limited to exchanging containers that consist corrosive material such as but not limited to sulfuric acid, employees are exposed to  with potential hazards such as, but not limited to eye irritation, redness, or irreversible corneal damage.     The employer did not ensure the emergency eye wash/shower station, in these areas, was maintained in accordance to ANSI Z358.1, 2009. The emergency eyewash station presented the following conditions:                    a. Emergency eyewash/shower station was not activated weekly to ensure operability and availability of water    b. Employees had not received training on the emergency eyewash/shower station

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a.) Core Area: The machine operator was exposed to continuous noise levels at 73% of the permissible 8 hour time weighted average of 85 decibels (dBA). The equivalent dBA level of 73% is approximately 87.5dBA. A sampling survey was conducted on August 24, 2014 for 420 minutes. A zero time exposure was assumed for the period of time that was not sampled.    b.) DISA: The machine operator was exposed to continuous noise levels at 115% of the permissible 8 hour time weighted average of 85 decibels (dBA). The equivalent dBA level of 115% is 91.1dBA. A sampling survey was conducted on August 26, 2014 for 420 minutes. A zero time exposure was assumed for the period of time that was not sampled.    c.) Melt-Pour Area-Controller: The machine operator was exposed to continuous noise levels at 140% of the permissible 8 hour time weighted average of 85 decibels (dBA). The equivalent dBA level of 140% is  92.4dBA. A sampling survey was conducted on August 26, 2014 for 420 minutes. A zero time exposure was assumed for the period of time that was not sampled.    d.) Melt-Pour-Timer: The timer was exposed to continuous noise levels at 120% of the permissible 8 hour time weighted average of 85 decibels (dBA). The equivalent dBA level of 69% is 91.3dBA. A sampling survey was conducted on August 26, 2014 for 420 minutes. A zero time exposure was assumed for the period of time that was not sampled.
