29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about June 19, 2014 and times prior thereto, employees of Jose Rangel were observed framing a two story residence being constructed at or near 805 Smithfield Drive in Jonesboro, Arkansas.  Employees were observed walking and working below employees working overhead on the rooftop.  The employer required the use of protective helmets, exposing employees to overhead hazards.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  On or about June 19, 2014 and times prior thereto, employees of Jose Rangel were observed working and walking on assembled scaffolding while framing the two story residence being constructed at or near 805 Smithfield Drive in Jonesboro, Arkansas.  The scaffolding had been designed by Jose Rangel and the employees who were not qualified in scaffolding, exposing employees to fall hazards.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide:  On or about June 19, 2014 and times prior thereto, employees of Jose Rangel were observed framing a two story residence being constructed at or near 805 Smithfield Drive in Jonesboro, Arkansas.  An employee was observed walking and working on a worksite constructed scaffold with a platform of 6 inches, exposing the employee to a fall distance of 11 1/2 feet to the ground level below.

The employer and the employees had assembled three worksite constructed scaffolds.  Scaffold legs and uprights did not bear on base plates, mud sills, or other adequate firm foundation, exposing employees to fall hazards.

The employees used ladders to access scaffold platforms.  The ladders used did not extend at least 3 feet above the upper landing surface being accessed, exposing the employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about June 19, 2014 and times prior thereto, employees of Jose Rangel were observed framing a two story residence located at or near 805 Smithfield Drive in Jonesboro, Arkansas.  Employees performing decking operations on the steep sloped rooftop with a pitch of 12:12 were not protected from falling with the use of fall protection.  Jose Rangel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 908060, citation number 1, item number 1, and was affirmed a final order on January 16, 2014 with a final abatement date of June 11, 2013, with respect to a workplace located at or near 4516 Kali Drive in Jonesboro, Arkansas.
