On or about June 19, 2014 and times prior thereto, employees of Jose Rangel were observed framing a two story residence being constructed at or near 805 Smithfield Drive in Jonesboro, Arkansas. Employees were observed walking and working below employees working overhead on the rooftop. The employer required the use of protective helmets, exposing employees to overhead hazards.

Employees performing decking operations on the steep sloped rooftop with a pitch of 12:12 were not protected from falling with the use of fall protection. Jose Rangel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 908060, citation number 1, item number 1, and was affirmed a final order on January 16, 2014 with a final abatement date of June 11, 2013, with respect to a workplace located at or near 4516 Kali Drive in Jonesboro, Arkansas.
