29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 06/23/14, in a trench/excavation on construction site on the west side of Parkhurst Blvd., south of Moore Ave., Tonawanda, NY: An employee entered a trench that was 10 ft. 9 in. deep x approx. 4 ft. wide x 52 ft. long to put "soap" on the gasket at both ends of the sanitary sewer pipe laying on the trench bottom, and to rake & grade the stone. There was an existing phone and fiber optic cable running diagonally below the top of the trench. The east and west banks of the trench were vertical. No protective system was provided to protect the employee from a cave-in hazard. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about 06/23/14, in a trench/excavation on construction site on the west side of Parkhurst Blvd., south of Moore Ave., Tonawanda, NY: An employee entered a trench that was 10 ft. 9 in. deep x approx. 4 ft. wide x 52 ft. long using a ladder. While the employee was in the unprotected trench, the ladder was removed leaving no other safe means of egress. NO ABATEMENT CERTIFICATION REQUIRED
