29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a). At the Race Trac construction site in Fort Myers no guardrail system was installed at the scaffold section where an employee was exposed to a 12-foot fall hazard on or about July 2, 2014.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder. (a) (a) At the Race Trac construction site in Fort Myers the ladder used to gain access to the scaffold platform was not positioned 3 feet above the platform landing in that it was positioned 1 foot 6 inches exposing the employees to a fall hazard on or about July 2, 2014.
