29 CFR 1926.300(b)(3): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about May 22, 2017, at the above addressed jobsite, an employee was exposed to the amputation hazard while putting his hand to a point of operation  in order to turn on a concrete mixer that the yoyo broke and the guard was removed.

Crossbraces were used as a means of access:  On or about May 22, 2017, at the above addressed jobsite, employees were exposed to an 8-foot fall hazard while accessing work areas using the side of a welded tubular scaffold as a ladder.
