29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.         a) Park St., Town Square, Robbinsville, NJ:  The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, EM Framing Enterprises Inc. employees conducting framing activities at the edge of the second floor decking of a residence under construction were not using fall protection (guardrails, positioning systems, PFAS, etc.) and were thus exposed to a fall hazard of greater than 20 feet.  Observed on or about 7/15/2014.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.   a) Park St., Town Square, Robbinsville, NJ:  On or about 7/15/2014, EM Framing Enterprises Inc. employees were conducting framing activities at the edge of the second floor decking of a residence under construction, were not using fall protection, (guardrails, positioning systems, PFAS, etc.) and were thus exposed to a fall hazard of greater than 20 feet.  The employer had not trained each employee exposed to fall hazards to recognize the hazards of falling and the procedures to minimize these hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a) Park St., Town Square, Robbinsville, NJ:  On or about 7/15/2014, EM Framing Enterprises Inc. employees were conducting framing activities at the edge of the second floor decking of a residence under construction, were not using fall protection, (guardrails, positioning systems, PFAS, etc.) and were thus exposed to a fall hazard of greater than 20 feet.
