29 CFR 1910.134(c)(1)(viii): The written program did not contain provisions for training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance.  On or about July 22, 2014 at the above addressed jobsite, the employer did not provide training in the proper use of respirator type 3M elastomeric half mask with P1000 filters, including putting on (donning) and removing (doffing), how to use it and how to keep it in sanitary conditions.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:   On or about July 22, 2014, at the above addressed jobsite, the employer did not provide the information contained in Appendix D to employees using 3M N95 filtering face piece and 3M Half mask respirators elastomeric half mask respirator with P1000 filters while performing chipping and grinding operations.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a) Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.   On or about July 22, 2014, at the above addressed jobsite, the employer did not ensure employees were medically evaluated and able to use a respirator type 3M elastomeric half mask while performing chipping and grinding operations.
