29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Each employee performing roofing work in excess of (6) feet above lower levels with unprotected sides and edges is not protected from falling by conventional fall protection equipment. The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed during residential construction at 304 Gregory Lane in Neenah, Wisconsin where four (4) employees were not protected from fall hazards of approximately ten (10) feet to the ground on a low slope roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not require ladders used to access upper landing surfaces to extend 3 feet above the upper landing surfaces. This violation was most recently observed at 304 Gregory Lane, in Neenah, WI when employees were utilizing a twenty (20) ft. Louisville extension ladder to access/egress a roof surface at approximately ten (10) feet above compacted surface without grab rails above the upper landing surface. The Kimberly A. Rios DBA Rios Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 948141, citation number 03, item number 003, and was affirmed as a final order on 12-30-13, with respect to a workplace located at 534 E South River Street; Appleton, WI 54915.
