29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Each employee performing roofing work in excess of (6) feet above lower levels with unprotected sides and edges is not protected from falling by conventional fall protection equipment. The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed during residential construction at 1808 W. Pine St. in Appleton, Wisconsin where four (4) employees were not protected from fall hazards of approximately nineteen (19) feet to the ground on a high slope roof. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet high without adequate fall protection. Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) On and or about April 3, 2015, during shingling activities located at 1808 W. Pine St. in Appleton, Wisconsin, the employer did not ensure an employee was wearing eye protection when operating a pneumatic nail gun. Bacilio Rios Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA Inspection Number 948141, Citation Number 03, Item Number 001, and was affirmed as a Final Order on 12/20/13, with respect to a workplace located at 534 E South River Street, Appleton, WI 54915.
