29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a. Maintenance/Housekeeping - Employees are exposed to chemical and physical hazards when they use paints, thinners, cleaning products and operate machinery such as but not limited to a weed whacker which necessitate the use of personal protective equipment (PPE). The employer has not performed a hazard assessment of each and every job category with regards to the necessary personal protective equipment. The employer shall: 1. Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment; 2. Communicate the selection decisions to each affected employee and; 3. Select PPE that properly fits each affected employee. *ABATEMENT NOTE: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a. Maintenance/Housekeeping - The employer did not develop a written hazard communication program as required. Employees use chemical products such as Clark Kensington latex paints,, flammable spray paints, Ace flammable paint stripper, and BETCO concentrated cleaning products and bleach. Training has been provided. As a minimum, the employer needs to prepare: 1. A list of chemical products used; 2. A complete collection of Safety Data Sheets; 3. Develop a written training and information program for employees; 4. Address the labeling system that will be used in the workplace.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: Maintenance/Housekeeping - The employer failed to train potentially exposed employees on the new label elements (e.g. pictograms and signal words) and the new SDS formation by December 2, 2013 as required by the revised Hazard Communication Standard. Employees use hazardous chemicals such as but not limited to flammable paints, thinners, gasoline, and propane, and caustic BETCO cleaning products at the worksite.
