OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to molten metal explosion hazards: a) On or about August 22, 2014, at the site, the employer did not ensure that the scrap metal used to charge the ladle of molten steel was dry and free of any surface or entrained moisture, exposing employees to a fire/explosion hazard. Employees added wet scrap to a charging ladle resulting in a large explosion. Among other methods, one feasible abatement method to correct this hazard is to comply with the requirements of ASTM E 2349; Standard Practice for Safety Requirements in Metal Casting Operations. Paragraph 9.2.3 Charge Materials and Tools - Before their use, charge materials and tools, which are to be immersed in molten metal baths, shall be preheated to remove surface and entrained moisture. In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing or the equivalent on all open sides except where there is entrance to a ramp, stairway, or fixed ladder: a) On or about August 27, 2014, at the above located workplace, employees were required to work near the edge of an open pit. The pit was 10-12 feet deep. The edge was not guarded by a standard railing or the equivalent. Employees were exposed to hazards associated with falls.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written personal protective equipment (PPE) certification that identified the workplace evaluated; the person certifying that the evaluation was performed; the date(s) of the hazard assessment; and, which identified the document as a certification of hazard assessment: a) On or about August 27, 2014, at the above located workplace, employees were required to work with and around molten steel and others hazards. These hazards necessitated the use of personal protective equipment including, but not limited to protective clothing for melting and pouring operations, and fall protection equipment. The employer had not verified, through a written certification, that the required workplace hazard assessment had been performed.
