Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall, crushing, and struck-by hazards:     a) Employees were permitted to ride the bucket of an excavator to and from a trench having a depth of approximately 9 feet.    Among others, feasible and acceptable methods of abatement would include, not allowing employees to enter the bucket of an excavator or other similar equipment as described in the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):      a) Employees were not protected from the hazard of cave-ins by shoring, sloping, or other protective means while working in a trench having depths ranging between approximately 9 and 13 feet.       Pappas Company, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 111250, citation 1, item 2, and was affirmed as a final order on February 22, 2012, with respect to a worksite located at 1954 Henley Street, Glenview, Illinois.        In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
