29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used and maintained in a manner that would have prevented employee exposure to hazards: a) On or about March 26, 2026, at the above addressed jobsite, the employer did not ensure that shields, such as the Allen Trench Safety Corp. Badger Pro Boxes, were used in a manner consistent with the recommendations of the manufacturer. The box was used with end panels made of fin board with adjustable spreaders, which is not allowable per the manufacturer's tabulated data. b) On March 30, 2026, at the above addressed jobsite, the employer did not ensure that shields, such as the Allen Trench Safety Corp. Badger Pro Boxes, were used in a manner consistent with the recommendations of the manufacturer. The bottom trench shield was used with only three of the four spreaders installed. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

The employer did not ensure that employees were protected from cave-in hazards while in the excavation.
