29 CFR 1910.107(b)(5)(i): The spraying operations was not designed, installed or maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute    The employer does not ensure that the spraying operation was designed, installed and maintained so that the average air velocity over the open face or cross section of the booth was not less than 100 linear feet per minute.  This violation was observed on or about September 3, 2014, in the down draft spray booth where employees were exposed to a fire and inhalation hazard while spray painting when the air velocity was below 100 linear feet per minute.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the average air velocity of the spray booth is not less than 100 linear feet per minute.

29 CFR 1910.107(b)(5)(iv): Space within the spray booth on the downstream and upstream sides of filters were not protected with approved automatic sprinkler.     The employer does not ensure that space within the spray booth on the downstream and upstream sides of filters are protected by an approved automatic sprinkler. This violation was observed on or about September 03, 2014,  in the down draft spray booth where employees were exposed to fire hazards in that the down draft spray booth did not have an approved automatic sprinkler system on the downstream and upstream sides of the filters.      Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an approved automatic sprinkler system is installed on the downstream and upstream side of the filters.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT).  The employer does not ensure employees required to use tight-fitting facepiece respirators pass the appropriate fit test. This violation was observed on or about September 03, 2014, in the paint area where employees wearing respirators were exposed to inhalation hazards when spray painting industrial equipment without being fit tested.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees using tight-fitting respirators pass the appropriate fit test.

The employer does not ensure that each container of hazardous chemical in the workplace was labeled, tagged or marked with the identify of the hazardous chemical(s) contained therein.  This violation was observed on or about September 3, 2014, in the mixing area where employees put leftover paints and solvents into an unmarked fifty-five gallon drum.   Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that containers of hazardous chemicals in the workplace are labeled, tagged or marked with the identity of the hazardous chemicals.
