29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Site - On or about 09/02/14 and at times prior thereto employees were installing the second floor joists and climbed onto the top plate by use of a 6 ft. step ladder which did not extend 3.0 ft. above the top plate. Employees stood on the top step of the ladder to reach the top plate of the wall situated at a 10 ft. elevation from ground level. (The gap between the top step of the ladder and top plate of the wall was 42 in.). (Inspection at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108, Cumming, GA 30340). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Employees stood on the top step of the ladder to reach the top plate of the wall situated at a 10 ft. elevation from ground level. The employer did not ensure that employees were trained by a competent person in the safe use of ladders and in the recognition of the associated hazards.
