29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     Jobsite:   Unit 20     Employees were exposed to fall hazards of up to approximately 11 feet while working on the second floor.    Instance A:   The area around the stairway floor opening was unprotected.    Instance B:   The floor edge above the garage was unprotected.    Instance C:    There were floor holes in the plywood over the garage.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Jobsite:    The employer did not provide adequate fall protection training for employees potentially exposed to falls.    Mota Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1) on three separate occasions in the last 5 years:    1)  OSHA inspection number 903955, citation number 3, item number 2 and was affirmed as a final order on November 4, 2013, with respect to a workplace located at Adams Farm Road in Shrewsbury, MA.      2)  OSHA inspection number 899817, citation number 2, item number 2B and was affirmed as a final order on July 25, 2013, with respect to a workplace located at Crystal Pond Road in Southborough, MA.      3)  OSHA inspection number 484998, citation number 1, item number 1 and was affirmed as a final order on August 23, 2012 with respect to a workplace located at 36 Allen Road in Wellesley, MA.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:  Jobsite:  Units 20 and 21  Stairways were not provided with hand rails and / or stair rails.  Instance A:   A Unit 20 stairway with an open side lacked both a hand rail and a stair rail.  Instance B:   A Unit 21 stairway with an enclosed stairway lacked a hand rail.   Mota Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1052 (c)(1) which was contained in OSHA inspection number 482118, citation number 1  , item number 1 and was affirmed as a final order on July 25, 2012, with respect to a workplace located at Nolan Ct. in Tewksbury, MA.
