29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.    a) The employer failed to provide documentation and certification for abatement of citation 1 item 1 in which the employer failed to develop an accident prevention program. Condition noted on or about 10/02/14.    b) The employer failed to provide documentation and certification for abatement of citation 1 item 2 in which the employer did not provide fall protection which would include guardrail systems, safety net systems, or personal fall arrest systems. Condition observed on or about 10/02/2014.    c) The employer failed to provide documentation and certification for abatement of citation 1 item 3 in which the employer did not provide each employee with a fall protection training program. Condition noted on or about 10/02/2014.    d) The employer failed to provide documentation and certification for abatement of citation 1 item 4 in which portable ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. Condition observed on or about 10/02/2014.

29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.      a) Vaughn Way, Country Woods, Burlington, NJ:  On or about 10/02/2014 two DePaula Carpentry Inc. employees were  conducting framing activities on a new construction multi story residential structure.  The employees were exposed to hazards related to a lack of fall protection, lack of fall protection training and improper use of a ladder to access the upper level of the structure.  The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.      The employer, DePaula Carpenters, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 975220, citation number 01, item  number 001 and was affirmed as a final order on 07/08/2014, with respect to a workplace located at 45 Montclaire Road, Medford, NJ 08055.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.     a) Vaughn Way, Country Woods, Burlington, NJ:  On or about 10/02/2014 two DePaula Carpentry Inc. employees conducting framing activities on a new construction multi story residential structure were walking the first floor top plate, installing the second story floor joists and decking.  The employees were not using fall protection and were exposed to a fall hazard of greater than 13 feet.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.      a) Vaughn Way, Country Woods, Burlington, NJ:  On or about 10/02/2014 two DePaula Carpentry Inc. employees conducting framing activities on a new construction multi story residential structure, walking the first floor top plate, with no form of fall protection, were exposed to a fall hazard of greater than 13 feet.  The employer had not trained employees exposed to fall hazards to recognize the hazards as well as the procedures to minimize these hazards.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access:      a) Vaughn Way, Country Woods, Burlington, NJ:  On or about 10/02/2014 two DePaula Carpentry Inc. employees were conducting framing activities on the second story decking of a new construction multi story residential structure.  The ladder that the employees used to access the upper level did not extend above the landing exposing them to a fall hazard of greater than 13 feet.            NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
