29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) Columbia Chutes LLC did not develop, implement, and maintain a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:          1) Requirement for labeling of containers or hazardous chemicals;      2) Material safety data sheet availability;      3) Training of employees;      4) A complete list of hazardous chemicals known to be in the workplace;      5) Methods to inform employees of the hazards of non-routine tasks; and       6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary          measures to protect employees.      Employees were exposed to hazardous chemicals, such as, but not limited to, metals (iron oxide, manganese, copper)   contained in fumes when welding on steel; methylene chloride contained in anti-spatter used to clean welding nozzles; toluene and ketones contained in spray paint used to spray on welds; and, petroleum asphalt contained in Coating 932 and used to apply on chutes.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace:  a) Columbia Chutes LLC - Material safety data sheets (MSDS) were not available for: filler metal used for MIG welding on steel; anti-spatter used to clean welding nozzles; and, spray paint used to spray on welds.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1052(d)(2): The employer did not perform initial monitoring to determine each employee's exposure to methylene chloride:  a) Columbia Chutes LLC did not perform initial monitoring to determine the welder's exposure to methylene chloride when the welder uses anti-spatter containing methylene chloride to clean the welding gun nozzle.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.1200(h)(3)(iv):  Employee training did not include the details of the hazard communication program, including an explanation of the labels received on shipped containers and the workplace labeling system used by the employer; the safety data sheets, including the order of information and how employees can obtain and use the appropriate hazard information:    a) Columbia Chutes LLC did not provide training to employees by December 13, 2013 that included an explanation of the labeling system elements and the safety data sheet (SDS) format as required by the updated hazard communication standard. Employees use hazardous chemicals which include: NOW aluminum spray paint (contains toluene, ketones and is flammable); Anchor Anti-spatter (contains methylene chloride).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
