29 CFR 1926.502(j)(7)(i): Material and equipment were stored within 6 feet (1.8m) of a roof edge: a) Roofing materials and equipment were stored along the edge of the roof deck exposing employees to the hazard of falling approximately 22 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) Employees were exposed to the hazard of falling approximately 22 feet from the edge of the roof deck while engaged in roofing activities without the use of fall protection or safety monitoring. L. Marshall , Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.502 (h)(1)(v) which was contained in OSHA inspection number 313940348, citation 1, item 2, and was affirmed as a final order on or about January 6, 2011, with respect to a worksite located at 363 W. Hill Street, Chicago, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
