29 CFR 1910.119(m)(1): The employer did not investigate each incident which resulted in, or could reasonably have resulted in a catastrophic release of highly hazardous chemical in the workplace.    a)  On or about June 11, 2014, the employer did not conduct an incident investigation of a 200 gallon spill of xylene from a day tank, which was part of the process, into a diked area of the tank farm on the southwest corner of the main production building.      b)  On or about June 16, 2014, the employer did not conduct an incident investigation of a release of chemical fumes from products L-209 and EB123X, which caused a plant evacuation.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
