29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the controls neutralized: (a) On or about February 15, 2015 an employee was injured when pinned between the guardrail and back tire of a forklift as the controls on the forklift controls were not neutralized prior to dismounting in that it was left in reverse and the parking brake had failed resulting in the unexpected movement of the forklift.
