29 CFR 1910.147(c)(4)(i): Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:     A)    Midtown Pallet & Recycling, Inc., located at 1987 Hawthorne Drive, Toledo, OH 43606: On or about November 10, 2014, the employer failed to utilize machine-specific energy control procedures to control hazardous energy of equipment such as, but not limited to, the horizontal band saw # 3 located in the North building. Employees did not verify that hazardous electrical energy source was isolated and deenergized prior to performing maintenance activities such as, but not limited to, changing a blade. Employees were exposed to amputation hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.147(d)(6): Prior to starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and deenergization of the machine or equipment had been accomplished:    A)    Midtown Pallet & Recycling, Inc., located at 1987 Hawthorne Drive, Toledo, OH 43606: On or about November 10, 2014, the employer did not ensure that hazardous energy sources were isolated and deenergized prior to conducting work such as, but not limited to, changing a blade on the equipment such as, but not limited to, the horizontal band saw # 3 located in the North building. Employees were exposed to injuries from unexpected start-up of the machine and energy release.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:     A)    Midtown Pallet & Recycling, Inc., located at 1987 Hawthorne Drive, Toledo, OH 43606: On or about November 10, 2014, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in incidents/near misses while driving a Nissan forklift (Model MP1F2A25LV, Chassis # P1F2-9H5822) in the facility. On multiple occasions, wooden pallets, transported by the forklift operator, fell down resulting in the forklift damage. Employees were exposed to struck-by hazards due to the lack of re-training.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Employees were exposed to lacerations, fractures, and broken bones hazards.
