29 CFR 1926.652(b)(2): Determination of slopes and configurations using Appendices A and B. Maximum allowable slopes, and allowable configurations for sloping and benching systems were not determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart. A. KMU Trucking and Excavating Inc. worksite located on English Turn, Avon Lake, Ohio: On or about January 13, 2015, the employer did not ensure the protective system (benching) put in place met the requirements of the appendix B of subpart P. After the employer identified the soil as type C, the insufficient method of benching was chosen and utilized. Benching does not meet the requirements of a protective system for a trench consisting of type C soil (cite: appendix B of subpart P). Employees installing precast storm sewer pipe were exposed to cave-in hazards up to 7.00 feet deep.
