29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace: On June 6, 2017, employees were conducting demolition work in the basement level of the Oberlin College Bibbins Building. The employees were utilizing respiratory protection. The employers respiratory protection program was deficient in that employees did not receive a medical evaluation prior to use.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: On June 6, 2017, employees were conducting demolition work in the basement of the Oberlin College Bibbins Building. The employer did not provide the Appendix D information for the employees who were voluntarily utilizing respiratory protection. One employee was wearing a dual cartridge respirator over facial hair (beard) and another employee was wearing a filtering face piece (dust mask).
