29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid:    At the inspection site, on or about January 13, 2015, and at times prior thereto, the employer elected to use a nearby clinic that was not equipped to provide the required 30 minutes of flushing for chemical burns to the eyes. The nearest facility equipped to handle treatment of all injured employees was approximately 50 minutes away. Employees in the plant were not adequately trained to provide the first aid required to lessen the severity of the injury, exposing employees to the hazards of delayed medical treatment.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    In the chemical cage, where employee(s) were dispensing highly corrosive chemicals from drums and totes into open pails including, but not limited to, Enviro Klor HD (potassium hydroxide), facilities for quick drenching or flushing of the eyes and body were not accessible for immediate emergency use within the work area in that travel around containments for drums/totes and the long gate was required to reach the eye wash outside the chemical cage, and the nearest emergency shower/eyewash was located at least 50 feet away in the battery charging area, where employee(s) would have to travel around forklifts and pallet jacks, exposing employees to the hazards of corrosive chemical splashes.

29 CFR 1910.242(a): Hand and portable powered tools or equipment were not kept in safe condition:    At the inspection site, on or about January 13, 2015, and in times prior thereto and thereafter, where employees were cleaning production equipment and surfaces with a portable tank foamer powered by compressed air, the pressurized foam discharge hose was not provided with a fail safe valve/deadman control, exposing employees to the hazards of being struck by the uncontrolled nozzle or corrosive foam stream if the employee lost his/her grip during cleaning operations.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:    In the chemical cage area, highly corrosive chemicals including, but not limited to, Enviro Klor HD (potassium hydroxide) were dispensed from drums and totes into open pails in lieu of containers with covers, and employees were carrying these open pails through the plant to food production areas for use in cleaning and sanitation processes, exposing employees to the hazards of corrosive chemical splashes.
