Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to being struck by or crushed by hazards:   On or about January 23, 2015, and times prior thereto, in the welding shop, the employer did not ensure that all equipment used to aid in the process of lifting and/or moving structural steel and other material was inspected, such as the 1 ton CM hoist, series 622, (no serial number) where the safety latches on the hook were missing.

In the cutting room the exit door was blocked by steel material used for fabrication.          b.     In the storage and tool maintenance room, the exit door was blocked by wooden panels.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   On or about January 23, 2014, and times prior thereto, chop saws used by employees to cut metal material were not equipped with a blade guard that completely enclosed the blade exposing employees to the hazard of amputation:         a.  In the welding shop:  a Dewalt chop saw guard was tied in the up position.       b.  In the cutting room:  a Brilliant cut off saw had a missing guard.
