29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks: At a metal building commercial construction project, an employee was lifting and lowering a welding employee from a scaffold platform using a Genie (TEREX) GTH-636 Telehandler, Serial Number C90175 that was not designed by the manufacturer to transport or lift personnel. The employer did not ensure the operator was knowledgeable, understood and followed the operating instructions, warnings, and precautions and exposed the employees to a fall hazard of approximately 6 feet or greater to the ground below.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: At a metal building commercial construction project, an employee operating a Genie (TEREX) GTH-636 Telehandler, Serial Number C90175 was lifting and lowering an employee performing welding work from a scaffold platform exposing the employee to fall hazards of approximately 6 feet or greater to the ground below: a. The platform was not an approved work platform by the manufacturer for capacity, construction, use, and fall protection. b. The Genie (TEREX) GTH-636 Telehandler was not designed by the manufacturer to transport or lift personnel or as a personnel lifting device.
