29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:           Maintenance - The employer did not develop a written hazard communication program as required.  Employees use chemical products such as flammable spray paints and gasoline, degreasers, lubricants, and pool chemicals.  Some safety data sheets (SDSs) are available.  At a minimum, the employer needs to prepare:        1. A list of chemical products used;   2. A complete collection of Safety Data Sheets;       3. Develop a written training and information program for employees;      4. Address the labeling system that will be used in the workplace.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):   Maintenance - Employees have been provided personal protective equipment such as face shields, protective eyewear, earmuffs and plugs, gloves, hard hats, and fall protection to protect them against hazards such as flying particles when grinding surfaces, chemical splashes, hearing loss, or fall hazards.  A hazard assessment has not been performed to include the following elements:        1.  Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment;  2.  Communicate the selection decisions to each affected employee and;  3.  Select PPE that properly fits each affected employee.        *ABATEMENT NOTE:  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and which identifies the document as a certification of hazard assessment.
