29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:   Located in the maintenance department, the employer did not ensure each employee who accesses the attic area for HVAC filter maintenance was protected from falling 4 feet or more to the floor level below by a guardrail system. Employees are exposed to a fall hazard from an unprotected area where the wall did not extend to the ceiling and guardrails were not in place.

29 CFR  1910.334(a)(2)(ii): When there was a defect or evidence of damage that could expose an employee to injury, the defective or damaged item was not removed from service until the repairs and tests necessary to render the electric equipment safe had been made:  Located in the main kitchen,  an Avantco Equipment 12" automatic deli slicer, serial number SL512, had damage to the outer jacket of the cord, exposing the internal components. Employees are exposed to an electrical hazard that can result in shock.

29 CFR  1910.23(b)(8): The employer did not ensure that ladders are used only for the purposes for which they were designed.  Located in the maintenance room, a Louisville Ceiling Mounted Folding Attic ladder, model AE2250, was used to access the attic area for HVAC filter maintenance. The ladder was designed for residential use only by the manufacturer and was not intended for use in commercial or industrial settings. Employees are exposed to a fall hazard from potential equipment failure.
