OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicles due to inadequate illumination. (a) 30 West Yaphank Road, Medford, NY (Worksite), Coram Yard Employees walking and working in the yard areas of the facility were exposed to being struck by vans, buses, and privately owned vehicles due to inadequate illumination. Direct reading illumination levels ranged between 0 - 12 foot candles (fc) / 0 to 129.2 lux (lx), throughout the yard areas on, or about February 5, 2015. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000.

29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc. (a) Worksite, Yard(s) - Employees walked across uneven ground and through potholes when they performed maintenance activities in the yard; and when they accessed their buses and/or vans on, or about February 5, 2015 and March 16, 2104. Note: The employer is required to submit abatement certification for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000. The aforementioned "single employer / integrated enterprise" was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(a)(7), which was contained in OSHA inspection number 966081, citation number 1, item number 1 and was affirmed as a final order on 10/9/14, with respect to a workplace located at 3040 Veterans Memorial Highway in Bohemia, NY. The aforementioned "single employer / integrated enterprise" was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(a)(7), which was contained in OSHA inspection number 966379, citation number 1, item number 1 and was affirmed as a final order on 10/9/14, with respect to a workplace located at 1 Grumman Road East in Bethpage, NY. The aforementioned "single employer / integrated enterprise" was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(a)(7), which was contained in OSHA inspection number 966391, citation number 1, item number 1 and was affirmed as a final order on 10/9/14, with respect to a workplace located at 30 West Yaphank Road in Coram, NY.
