29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces were not corrected or repaired before employees used the walking-working surface and for corrections or repairs that could not be made immediately, the hazard was not guarded to prevent employees from using the walking-working surface until the hazard was corrected or repaired: a) Worksite, Three Village Yard: Employees walked across uneven ground and through several potholes (ranging from up to and including approximately 2' by 1.3' to approximately at least 35 ft. by 10 ft. and ranging from approximately 1" to 3" deep) throughout the yard when accessing their buses and/or vans on or about 10/18/17. b) Worksite, Bohemia Yard: Employees walked across uneven ground and through several potholes (ranging from up to and including approximately 2 ft. in diameter to approximately at least 6 ft. by 5 ft. and ranging from approximately 1" to 5" deep) throughout the yard when accessing their buses and/or vans on or about 10/18/17. c) Worksite, Three Village Yard: Employees walked across uneven ground and through potholes (ranging from up to and including approximately 4" in diameter to approximately at least 10' by 17' and ranging from approximately .5" to approximately 1" deep) when accessing their buses and/or vans on or about 3/15/18. d) Worksite, Bohemia Yard: Employees walked across uneven ground and through potholes (ranging from up to and including approximately 4" in diameter to approximately at least 15' by 16' and ranging from approximately .5" to approximately 4" deep) throughout the yard when accessing their buses and/or vans on or about 3/15/18. The aforementioned "single employer / integrated enterprise" was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1031447, citation number 2, item number 1 and was affirmed as a final order on 11/2/15, with respect to a workplace located at 3040 Veterans Memorial Highway in Bohemia, NY.
