OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about February 6th, 2015, at the above addressed job site, an employee was exposed to fall hazards during tree trimming operations. The employee was trimming hedges with a gas powered trimmer as he stood on the top rail of the cage that was affixed to a Gator tractor whilst it was being driven by another employee.
