29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: 321 W. 35th St., New York, NY. On or about 2/10/15; a) Employer did not install a section of guardrail at the 25th floor exposing employees to a potential fall of approximately 25 stories to the floor below. b) Employer did not install a guardrail at the perimeter of the staircase of the 25th floor exposing employees to a potential fall of approximately 12 ft. to the temporary floor below. On or about 2/11/15; c) Employer did not ensure that subcontractors installing telecommunication cabling were protected from fall hazards as they use an A frame ladder immediately adjacent to the guardrail system protecting an elevator shaft opening. The employee used the ladder at a height greater than the top of the guardrail potentially exposing him to a fall of up to 6 stories to the floor below. Flintlock Construction Services, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 910581, citation number 1, item number 4 and was affirmed as a final order on 11/24/13, with respect to a workplace located at 451 Lexington Ave, New York, NY.
