29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a) Production area- An employee operating  a saw that was cutting metal tubing was exposed to continuous noise at 81.5 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.5 dBA during the 470 minute sampling period on April 2, 2015. The exposure calculation included a zero increment for the 10 minutes not sampled.       (b) Production area- An employee operating the 60 ton press was exposed to continuous noise at 169.2 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 93.8 dBA during the 231 minute sampling period on April 2, 2015. The exposure calculation included a zero increment for the 249 minutes not sampled.      (c) Production area- An employee who operated the automatic saw and operated the small press was exposed to continuous noise at 122.3 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 91.5 dBA during the 472 minute sampling period on April 2, 2015. The exposure calculation included a zero increment for the 8 minutes not sampled.     An effective hearing conservation program would include, initial baseline and annual audiograms, making hearing protectors available, and initial and annual noise training.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of particulate not otherwise regulated (PNOR) total dust listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 15 milligrams per cubic meter (mg/m3):    a) Spray Booth- An employee powder coating metal ladders was exposed to particulates not otherwise regulated (PNOR, total dust) at 40.0 mg/m3, which is 2.7 times the Permissible Exposure Limit (PEL) of 15 mg/m3.  The exposure was determined from four samples totaling 468 minutes.  Zero exposure was assumed for the un-sampled 12 minute period.
