29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Production area- An employee operating the repro grinder was exposed to continuous noise at 109.7 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 90.7 dBA during the 425 minute sampling period on February 19, 2015. The exposure calculation included a zero increment for the 55 minutes not sampled. The employee had not received an audiogram or noise training.    (b) Production area- The Xpak operator was exposed to continuous noise at 66.5 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 87.1 dBA during the 444 minute sampling period on February 19, 2015. The exposure calculation included a zero increment for the 36 minutes not sampled. The employee had not received an audiogram or noise training.    (c) Production area- The 6 Ft. Cast Line operator was exposed to continuous noise at 82.9 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.7 dBA during the 441 minute sampling period on February 19, 2015. The exposure calculation included a zero increment for the 39 minutes not sampled. The employee had not received an audiogram or noise training.    (d) Production area- The 4 Ft. Cast Line operator was exposed to continuous noise at 86.0 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.9 dBA during the 439 minute sampling period on February 19, 2015. The exposure calculation included a zero increment for the 41 minutes not sampled. The employee had not received an audiogram or noise training.   (e) Production area- A 4 Ft. Cast Line helper was exposed to continuous noise at 80.2 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.4 dBA during the 438 minute sampling period on February 19, 2015. The exposure calculation included a zero increment for the 42 minutes not sampled. The employee had not received an audiogram or noise training.     An effective hearing conservation program would include, initial baseline and annual audiograms, making hearing protectors available, and initial and annual noise training.
