OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:       a)      Bradford Forest, Inc., 444 High Street, Bradford, Pa 16701:  Layout area of the Log yard:  On or about March 5th, 2015 and times prior thereto, the employer failed to provide a place of employment free from the recognized hazards of pedestrians being struck-by mobile heavy equipment (e.g. Front end/Wheel Loaders) and vehicular traffic while walking/working in and around blind spots/intersections associated with roadways and vehicular traffic areas in the log yard due to a lack of pedestrian safety controls/programs.  A loader operator operated a Caterpillar brand (Model IT38G, Serial # 55K06408) Front End/Wheel loader through "row 1" of the layout area of the log yard.  A log scaler (pedestrian) was performing scaling operations in "row 1" of the layout area.  The log scaler was struck by the Wheel Loader while conducting routine work operations.      Feasible Abatement Methods:  Among other means, acceptable and feasible methods to correct the conditions included but are not limited to:    1) Conduct a complete evaluation of the log yard, and roadways to identify blind spots and/or congested intersections;    2) Train pedestrians, through education and enforcement, about walking facing traffic and being alert of potential vehicular hazards;    3) Develop designated pedestrian-only and/or vehicle-only routes of travel;    4) Install and designate specific pedestrian safety zones where pedestrians and vehicles travel the same routes;    5) Train all operators of vehicles, trucks, loaders, and other material handling equipment through education and enforcement to be consistently aware of any and all pedestrians around the path of travel;    6) Develop a written policy that requires operators of vehicles, trucks, loaders, and other material handling equipment to slow down and sound the horn at cross aisles, log rows, and other locations where vision is obstructed;    7) Train all operators of vehicles, trucks, loaders, and other material handling equipment to slow down and sound the horn at cross aisles and other location where vision is obstructed or pedestrians are performing work operations;    8) Erect barriers to protect pedestrians from vehicular traffic in walkway areas/log rows/congested areas while performing work operations.  Erect barriers in a manner that ensures they are visible to operators of vehicles, trucks, loaders, and other material handling equipment to alert and hinder operators of these vehicles from entering specific areas where pedestrians are conducting work activities;     9) Erect lighted signals that are activated by a pressure pad before pedestrians step into blind spots and congested travel areas;    10) Appraise all visitors, guests, and contractors of plant speed limits, and blind intersections/corners and pedestrian crossing areas;    11) Ensure that all pedestrians in log yard areas wear hi visibility vest jackets or similar personal protective equipment while acting as pedestrians or performing work operations in the log yard areas.

29 CFR 1910.145(c)(3): Safety instruction sign(s) were not used where there was a need for general instructions and suggestions relative to safety measure(s):         a.) Bradford Forest, Inc., 444 High Street, Bradford, Pa 16701:  Layout area of the Log yard:  On or about March 5th, 2015 and times prior thereto, employees were exposed to struck-by hazards while working near and around the Caterpillar Front End/Wheel Loader (Model IT38G, Serial # 55K06408) and other vehicular traffic in the log yard.  Employees were required to work near and around Front End/Wheel Loaders and other vehicular traffic while conducting scaling operations in the log yard.  Signs warning pedestrians and equipment operators of the dangers of being struck-by heavy equipment were not posted in and around the roadways areas or pedestrian crossing areas of the log yard.
