29 CFR 1926.404(b)(1)(i): General. The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors.   a.     On the fourth level of the hotel being built, the employer did not use an assured grounding system or ground fault circuit interrupters to protect employees working on the fourth level of the hotel thereby exposing employees to a contact.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.     On the roof of the hotel being built, the the general contractor did not ensure employees of the framing contractor, Gutierrez LLC. were wearing a fall protection system while laying sheets of plywood thereby exposing employees to a 36 foot fall hazard.

29 CFR 1926.1052(b)(1): Except during stairway construction, foot traffic is prohibited on stairways with pan stairs where the treads and/or landings are to be filled in with concrete or other material at a later date, unless the stairs are temporarily fitted with wood or other solid material at least to the top edge of each pan. Such temporary treads and landings shall be replaced when worn below the level of the top edge of the pan.  a.     On the stairways from the 1st floor to the fourth floor, the the general contractor did not ensure the framing contractor, Gutierrez LLC. filled the stair pans before allowing employees to use them from floor to floor thereby exposing employees to s trip/fall hazard.
